ON
AUTHORIZATION OF ISSUANCE OF IMPORT APPROVAL OF
GOODS WITHOUT IMPORTER IDENTITY NUMBER (API)

THE MINISTER OF INDUSTRY AND TRADE,

Considering:

• a. that in the framework of ensuring the smooth import of goods without API as meant in Article 19 of Decree of the Minister of Industry and Trade No. 40/MPP/Kep/1/2003, it is necessary to appoint and stipulate the official to issue import approval of goods without API;
• b. that in relation thereto, a decree of the Minister of Industry and Trade needs to be issued;

In view of:

• 1. Presidential Decree No. 228/M/2001 on the establishment of the Mutual Cooperation Cabinet;
• 2. Presidential Decree No. 102/2001 on the status, tasks, functions, authority, organizational structures and working arrangements of ministries;
• 3. Presidential Decree No. 109/2001 on first-echelon organizational units and tasks of ministries;
• 4. Decree of the Minister of Industry and Trade No. 229/MPP/Kep/7/1997 on import general provisions;
• 5. Decree of the Minister of Industry and Trade No. 86/MPP/Kep/3/2001 on the organization and working arrangement of the Ministry of Industry and Trade;
• 6. Decree of the Minister of Industry and Trade No. 40/MPP/Kep/1/2003 on importer identity number (API);

DECIDES:

To stipulate :

FIRST:

To give the power for and on behalf of the Minister of Industry and Trade to the Director of Import, Directorate General of Foreign Trade to stipulate and sign the import approval of goods without API as meant in Article 19 of Decree of the Minister of Industry and Trade No. 40/MPP/Kep/1/2003.

SECOND:

The import approval of goods without API as meant in FIRST Dictum shall be enforced to the goods as meant in Article 2 paragraph (2) of Decree of the Minister of Industry and Trade No. 299/MPP/Kep/7/1997 on import general provisions and goods for other purposes not demanded continuously and not traded/transacted or transferred.

THIRD:

The goods for other purposes as meant in SECOND Dictum shall be production supporting or infrastructure development equipment.

FOURTH:

The authority as meant in FIRST Dictum cannot be delegated or authorized to other officials.

FIFTH:

To instruct the official as meant in FIRST Dictum to execute the task in accordance with his/her authority on the basis of Decree of the Minister of Industry and Trade No. 229/MPP/Kep/7/2003 in a full sense of responsibility.

SIXTH:

With the issuance of this decree, Instruction of the Minister of Industry and Trade No. 03/MPP/Inst/11/1999 shall be declared null and void.

SEVENTH:

This decree shall come into force as from the date of stipulation.

For public cognizance, this decree shall be published by placing it in State Gazette of the Republic of Indonesia.
